Trump Asks Supreme Court to Postpone TikTok Ban, Promising Resolution as President
President-elect Trump has filed an amicus brief with the Supreme Court requesting a delay in TikTok's ban implementation until after he takes office on January 20th.
The filing emphasizes Trump's self-proclaimed "consummate dealmaking expertise" and states he "alone possesses the electoral mandate and political will" to negotiate a resolution that would save the platform.
The current ban deadline is set for January 19th, just one day before Trump's inauguration. The Supreme Court has agreed to hear arguments about whether the ban violates First Amendment rights. The legislation allows presidential intervention if progress is made in separating TikTok from ByteDance, its Chinese parent company.
Recent developments include:
- Trump met with TikTok CEO Shou Chew at Mar-a-Lago two weeks ago
- A follow-up conversation between Trump and Chew occurred after the filing
- Trump publicly suggested "maybe we gotta keep this sucker around"
This represents a significant shift in Trump's stance, who previously advocated for TikTok's ban during his first presidency. His changed position emerged after joining the platform this year, where he urged users to support him to save TikTok.
Meanwhile, prominent politicians including Mitch McConnell and Ro Khanna have filed petitions urging the Supreme Court to reject TikTok's appeal.
