SoundExchange and AccuRadio have reached a temporary payment agreement amid their ongoing licensing dispute, with AccuRadio agreeing to pay $210,000 monthly while litigation continues.

The agreement, approved by Judge Matthew F. Kennelly, comes after SoundExchange filed a lawsuit in July alleging unpaid royalty payments from the internet radio service. Under the new arrangement, SoundExchange has withdrawn its preliminary injunction motion but maintains the right to reinstate it if needed.

Key Terms of the Agreement:

  • AccuRadio will pay $210,000 on the first of each month
  • Payments continue until final judgment is reached
  • Amount can be adjusted with mutual written consent
  • Modifications based on performance numbers and current regulatory rates
  • AccuRadio receives full credit for payments against final liability
  • SoundExchange can seek injunction if payments are missed

The payment structure accounts for AccuRadio's monthly performance metrics and non-subscription transmission rates. If AccuRadio defaults on payments, SoundExchange reserves the right to pursue expedited legal action or other appropriate remedies.

This case runs parallel to SoundExchange's separate royalty dispute with SiriusXM, which includes counterclaims from the satellite radio provider.
