BMI Takes SiriusXM to Court Over Music Payment Reduction Attempt
BMI has filed a legal action against SiriusXM in rate court, seeking to determine fair compensation for songwriters, composers, and publishers. The dispute centers on SiriusXM's alleged attempts to maintain outdated payment rates despite significant changes in their business model and market position.

BMI's key arguments include:

- BMI's significant market share, representing over 22.4 million songs and compositions
- Current rates no longer reflect fair value for music creators
Mike O'Neill, BMI's President and CEO, states that after two years of unsuccessful negotiations, legal action became necessary due to SiriusXM's insistence on maintaining rates that significantly undervalue music creators' contributions.
The petition, filed in New York court on September 12, requests either:
- Confirmation that BMI's proposed rates (quoted May 8, 2023) are reasonable
- Court determination of appropriate rates for the period January 1, 2022, through December 31, 2026
Under the existing Consent Decree, BMI must propose reasonable fees to music users, with both parties having the right to seek court intervention if an agreement cannot be reached.
