Danny Elfman has lost his bid to dismiss a defamation lawsuit brought by composer Nomi Abadi regarding statements he made to Rolling Stone in 2023. The lawsuit centers on comments made during an investigation about a secret sexual harassment settlement involving a former protégé.

Los Angeles Superior Court Judge Gail Killefer rejected Elfman's motion to dismiss, ruling that his statements to Rolling Stone did not qualify for litigation privilege. Elfman had claimed his comments were protected free speech made in anticipation of suing Rolling Stone - a lawsuit that never materialized.

Abadi filed the lawsuit in July 2023, claiming Elfman defamed her by making false statements denying any sexual misconduct. The lawsuit challenges Elfman's characterization of Abadi as a "scorned woman seeking revenge and money because she was rejected by her idol."

Key Background:

  • Elfman and Abadi previously entered into a non-public settlement and nondisclosure agreement following accusations of sexual misconduct between 2015-2016
  • Abadi sued Elfman for allegedly failing to pay the full $830,000 settlement
  • Elfman has denied all allegations of misconduct

Elfman's attorney, Camille Vasquez (known for representing Johnny Depp), stated they plan to appeal the decision, saying "We respectfully disagree with the court's ruling and are optimistic that the Court of Appeal will agree with us that this case ought to be dismissed."
